Server Rates

Did anybody else realize that with sv_maxrate 25000 or whatever set, doesn't enforce rates, but it makes it so that that is all they get, even if there rate is 81000 as I oftenly see.
I was told this today on the normall maps server and is this true or is it just an excuse for the dude to have pathetic rates? (Even though I made him change them anyway)

So, if you see someone with a rate of 50000 they do not actually have that rate, since the server is only allowing a maximum of 30000...
