The ROMs are classed under backups of material for personal use,
They've already taken R4 cards, they're likely to try and take ROMs next, though.

They are not classed as backups they are against copyright law just like making a copy of a CD and distributing it, personal copys and backups are not held on servers on the internet they are held on your PC.
